Florida Pet Lemon Law

Florida has one of the most far-reaching pet buyer protection laws in the nation.

The law applies to both cats and dogs, and it requires vaccinations and

examinations for animals prior to sale.

In summary, it provides that a pet dealer may not knowingly misrepresent the

breed, sex, or health of any dog or cat offered for sale within the state.

The definition of a pet dealer is explicitly written to include active hobby

breeders. A pet dealer is defined as anyone who sells more than 2 litters or 20

dogs per year, whichever is greater.

Consumers have 14 days to document contagious or infectious disease and a

full year to document congential or hereditary defects. There is no penalty for

failure to produce advertised registration papers.

The law provides for replacement plus reimbursement for veterinary expenses

related to certifying the illness, up to the price of the dog.

If a dog is proven ill or defect, consumers may demand a refund or replacement plus reimbursement of veterinary expenses up to the price of the dog.

The state's tough law makes it potentially very expensive to sell ill or defective

pets in Florida. Consider the scenario where a puppy is sold for $150 and has

its hips evaluated within 1 year. The x-rays could run up to $150. If they turn up definite hip dysplasia, the seller may have to provide either a refund or

replacement, plus cover the $150 for the x-rays.

It is the consumer's right to receive a certificate of veterinary inspection with

each dog or cat purchased from a pet dealer.

Such certificate shall list all vaccines and deworming medications administered to the animal and shall state that the animal has been examined by a Florida-licensed veterinarian who certifies that, to the best of the veterinarian's knowledge, the animal was found to have been healthy at the time of the veterinary examination.

In the event that the consumer purchases the animal and finds it to have been

unfit for purchase, the consumer must notify the pet dealer within 2 business

days of the veterinarian's determination that the animal was unfit.

The consumer has the right to retain, return, or exchange the animal and

receive reimbursement for certain related veterinary services rendered to the

animal, subject to the right of the dealer to have the animal examined by

another veterinarian.

The state attorney may bring an action to enjoin any violator from being a pet

dealer. Violations are a first-degree misdemeanor.

County-operated or city-operated animal control agencies and registered

nonprofit humane organizations are exempt from this section.

Terms of Sale

1. The buyer MUST have puppy examined by a licensed veterinarian at the buyer's expense within 48 business hours (excluding weekends and holidays) of pick-up or delivery if shipped for this contract to be valid, unless otherwise discussed. All puppies will be vet checked and have vaccinations prior to going to their new homes. They will come with all necessary papers and a Florida State health certificate with all current vaccines listed.

2. If a serious life threatening health problem is noted during the above examination, seller must receive a written statement from buyer's veterinarian within 48 business hours from date of examination. Upon verification by seller's veterinarian of stated health problem, puppy must be returned to seller unless otherwise agreed by seller. When available, the buyer will be provided with another puppy of the same sex, quality and value. No replacements will be given due to problems that result from buyer neglect.

However, if neglect is noted, buyer agrees to return dog to seller, money non-refundable.

3. Although we try to predict mature size of our pups, we do not guarantee it.

4. We do not guarantee against hypoglycemia. It is your responsibility to make sure your new baby is fed properly and given the proper rest a newborn requires.

5. If for whatever reason you cannot keep your puppy (e.g. allergies; moving; etc.) please return the puppy or contact us and we will help you find a loving home for it. We ask that you do not take the puppy to a pound. Money non-refundable.

6. According to the Florida Statue, Breeder is not responsible for any disease contributed to non-performance of new Owner to give shots and ensure health. Parasites can be picked up anywhere after leaving the breeder. Puppies cannot be guaranteed against hip dysplasia as it is not always hereditary and can happen due to injury, accidents, obesity, falling, jumping, environment, etc.....Please remember, your puppy is like a baby, he/she will need your guidance and training to make him a wonderful member of your family. We recommend puppy obedience classes for all breeds of dogs. We strive to make your puppy buying experience WONDERFUL.

Deposits On Puppies

We require a $100 deposit to hold a puppy and the balance by 8 weeks of age. The deposit is non refundable. I accept cash and money orders. PayPal may be used for quick deposits especially if you wish to use a credit card.  Please add a paypal fee of 3.5% to the deposit total.

We do not accept deposits until after the puppies are born and they are at least three weeks of age.

Age For Going To New Home

Under Florida law puppies must be 8 weeks old and have a health certificate from a certified veterinarian before being allowed to go home with its new owner. Therefore puppies do not leave my home until they are eight weeks of age. Each pup is seen by my vet and given a clean bill of health before leaving my care. If shipping is needed it would be at 8 to 10 weeks of age. I also hold the right to keep a puppy longer if I feel it is not mature enough to leave my home at 8 weeks of age.

REMAINING BALANCE

The remaining balance is to be paid by the time the puppy is picked up. It is to be paid in cash, money order or PayPal only. I do not accept personal checks on remaining balance.
